BMW 355d Giveaway Contest

1. How to Enter: No purchase necessary.  Contestants will automatically be entered by wearing their radio-frequency identification name badge, simply walking through the Gallery, visiting each exhibition booth during the 2009 Allstream Global Forum and having their name tag scanned in each of the exhibits.
2. Prizes: The prizes available to be won consist of the following:  2 year lease on a new BMW 355d Advanced Diesel vehicle.  The winner must take delivery of the vehicle at a BMW retailer located in the Greater Toronto Area.  The lease for the vehicle is solely between BMW and the winner, MTS has no standing in this regard.
3. Contest Eligibility: Contestants must be 18 years of age or older, a resident of Ontario, and have a valid driver’s license to participate in this contest.  Employees of MTS Allstream Inc. or any of its affiliated or associated companies (collectively “MTS”), and their immediate families with whom they reside, and any employee of their respective agents, representatives, promotional agencies and assignees are not eligible to win this contest.  Contestants who are delinquent in any indebtedness to MTS in respect of any other claims, or outstanding accounts for services (this does not apply to regular indebtedness for recurring monthly charges for services for which MTS has not made a formal demand to pay) are also not eligible to win.
4. Contest Closing Date:   The contest closing date is November 24, 2009.
5. Selection of Winners:  A draw will be made by MTS Allstream on November 26th, 2009.  The potential winner will be drawn randomly from the list of individuals that had their attendee badge scanned at all partner booths in the Gallery of Innovation on November 24th, 2009. The potential winner will be contacted by telephone or email and if he or she is unable to be reached in that manner within one week of the draw, another eligible entry will be drawn and the process will be repeated.
6. Chances of Winning: The chances of winning a prize will depend on the total number of guests who qualify for entry based on the selection criteria outlined above.
7. Release and Waiver: In order to be declared a winner, all randomly selected entrants will be required to complete, sign, and return a declaration, release and waiver of liability in the form provided by MTS within the time stipulated by MTS, and must have abided by the rules and regulations of this contest.  Failure to return the duly completed declaration, release and waiver form within the time stipulated or failure to abide by these rules will result in disqualification and another entry will be randomly selected from the remaining eligible entries.  Selected entrants may also be required to answer correctly a mathematical skill testing question without mechanical aid before being declared a winner.
8. No Substitutions by Winners: The prize must be accepted as awarded without substitution, and cannot be transferred.  The prize has no cash equivalent.
9. Decisions Final: All decisions made by MTS with respect to all aspects of this contest are final and not subject to challenge.  These rules may be amended at any time by MTS without notice.  MTS expressly reserves the right to take any steps it deems necessary in its absolute discretion, including the limiting of entries and the exclusion of entrants, in order to ensure that the contest is conducted in a fair way for all contestants and for MTS.
10. No Liability: MTS and its employees, agents, representatives, promotional agencies and assignees shall not be responsible in any way for loss or damage arising from the use of or, bear any liability whatsoever in any way attributable to, the prize awarded in this contest or the entry by a contestant herein.  Without limiting the generality of the foregoing, MTS assumes no responsibility or liability for any risk or dangers associated with the acceptance or use of the prize awarded as part of this contest or any liability associated with on-line or electronic entries, and expressly disclaims liability from loss or damage to a contestant's computer system howsoever caused arising from bugs, viruses or technical failures in any way associated with or arising from, on-line or electronic entries.
11. Entries belong to MTS: All entries become the property of MTS and will not be returned.
12. Lost Entries: MTS is not responsible for any lost, misdirected or delayed entries.
13. Consent to Use: By entering the contest, entrants consent to the use and publication of their name, photograph, voice or statements in connection with the contest or any subsequent similar contest held by MTS, without payment or compensation other than the chance to win the prize awarded.
14. Applicable Laws: This contest is subject to all applicable, federal, provincial and municipal laws and regulations and any dispute relating hereto will be determined by an Ontario court applying Ontario law and the laws of Canada as applicable therein.
15. Substitutions: MTS reserves the right to make a prize substitution of equivalent value in the event of unavailability of the prize or any aspect thereof for reasons beyond the control of MTS.
16. Errors and Omissions Excepted: MTS is not responsible for printing, distribution or production errors and may, in its discretion, withdraw this contest if it is found to contain any such error, without liability to anyone whatsoever.
17. Personal Information: The personal information obtained from the contest entry form will not be used or disclosed by MTS for any purpose other than general contest administration and the purpose set forth in section 13 above.
